1. the planning position:
The outline planning permission from Cheshire East 21/0640M is for demolition of 2 domestic garages, construction of one house with 2 parking spaces and access alterations.
Although the permission is in outline, details of access, landscaping, layout and scale are included in it.
The only matter reserved for future consideration is appearance.
The permission has 14 conditions attached and is dated 11/5/22, so the deadline for submission of the necessary application for approval of appearance is 11/5/25 (condition 2).
Buyers have the freedom to submit their own full planning application with different details if they wish, however, the principle of a 3-storey house on the site has been established already.
The permission has been granted on appeal since Cheshire East Council objected to the 3-storey scale of the proposal.
There were no other objections to the application, either from Council departments including Highways, or the public.
2. the access arrangements:
The existing access from Bedells Lane is via a gated track adjacent to the site in the freehold ownership of 25 Fulshaw Avenue, Wilmslow SK9 5JA.
There was an easement granted in 1925 that only provided an easement for access to the 2 domestic garages that are to be demolished.
The proposed access is via the existing track, but upgraded and with the gate relocated beyond the proposed parking spaces. This arrangement avoids the need to form an additional access from Bedells Lane with possible implications for highway safety, relocation of the bus stop and the future of the tree on the frontage.
Buyers are free to apply for planning permission for an independent access if they wish, however both planning permission and the current owners permission have been secured for upgrading the existing entrance.
The owners of the access have reached agreement with the vendors in the form of a Deed Of Release And Grant Of An Easement dated 07/03/23.
The Deed, which includes a plan, grants New Rights to access the site from Bedells Lane via the track (Schedule 2), subject to 8 Covenants entered into by the vendors (Schedule 3) that provide for resurfacing of the track, relocation of the gate, provision of a boundary fence and future repairs. Whoever owns the site will benefit from the New Rights but will be responsible for compliance with the 8 Covenants. The Consideration referred to in paragraph 3.1 has been paid already by the vendors. The vendors consider that the Deed's length is necessary to provide legal robustness and peace of mind for all the parties, however, in principle and in practical terms, the concept is simple and straightforward: an easement is granted in exchange for moving a gate, providing a boundary fence and upgrading a length of the track's surface.
